Inquiries Your CPC Will Make

The purchaser’s CPC will make inquiries of several government and semi-government departments to see if they have any proposals that may affect the property and also of council, water authority and land tax office to see if there are any rates or fees outstanding.

There are several departments that inquiries can be made of that have the right to either run pipes, wires etc through a property or resume part or all of the property. While the seller warrants that there are no proposals that effect the property the only way of testing these warranties is to obtain these certificates. Your CPC will know from which authorities and departments to make the appropriate inquiries.

If there is a proposal that affects the property and the seller is aware of it he should disclose that in the contract. If it is disclosed in the contract the purchaser may not be able to withdraw from the sale.

If there is no disclosure and the inquiry shows a proposal that affects the property then the purchaser may have a right to withdraw from the contract.
